EAT had no jurisdiction

Refreshment Systems Ltd t/a Northern Vending Services v Wolstenholme EAT TLR 2 March

Although the Employment Appeal Tribunal has jurisdiction under s21(l) of the Employment Tribunals Act 1996 to hear a wide range of appeals from employment tribunals, s21(l) does not confer jurisdiction to entertain an appeal arising out of the contravention of a worker’s right to be accompanied at a disciplinary or grievance hearing pursuant to s10 of the Employment Relations Act 1999. Accordingly, the EAT had no jurisdiction to hear the employer’s appeal against an award of £500 to the employee under s11 of the 1999 Act in respect of the breach of her right to be accompanied.
