£30,000 for Talaq

An arranged marriage between two Iranians lasted only seven weeks. After considering how the Iranian court would have dealt with the matter, the wife was awarded a £35,000 lump sum in ancillary relief proceedings, with a conditional £65,000 if the husband failed to grant her a Talaq divorce within a specified time. Under Shari’a law the wife was entitled to retain all her marriage portion if the husband divorced her by way of Talaq or failed to give her a divorce but, if the wife wanted the divorce, a Kuhla, she would need to negotiate what percentage of her marriage portion she would sacrifice for her freedom. The Court was satisfied that the order it made would be equitable.
