Error in counter-notice

Lay and others v Ackerman and another CA TLR 24 March

The tenants served a notice of claim under s42 of the Leasehold Reform, Housing and Urban Act 1993 to which the landlord served a counter-notice stated to be from the trustees of the Portman Collateral Settlement. It was common ground that no such body existed. The tenant contended that the counter-notice was invalid.
