Wrong admission

Loveridge v Healey [2004] EWCA Civ 173

Although the defendant had admitted in a defence to a fact that was not true, the court was not bound as a matter of law to disregard that admission. The correct procedure was for the defendant to apply for permission to amend his pleading.
