Tillery Valley Foods Ltd v Channel 4 Television Corporation and another ChD TLR 21 May

The second defendant was commissioned by the first defendant to make a TV programme concerning certain practices at the claimant’s factory, for which purpose one of its journalists obtained employment in the factory. The claimant sought an injunction prohibiting the showing of the programme on the ground that the journalist’s activities amounted to breaches of trust and confidence and that part of the balancing exercise between the public interest in preserving confidence and the public interest in disclosure of the information should involve giving the claimant a right of reply, which in turn involved allowing them to see the programme before it was transmitted.
