Post-writ contractual interest

Habib Bank Ltd v Dawood CA SJ 22 October

The judge refused to allow the claimant bank to amend its statement of case to include a claim for contractual compound interest against the defendant who had guaranteed a debt owed to the bank by a third party. The writ accompanied by a statement of claim sought only statutory interest. The judge held that the claimant had not been entitled to claim post-writ contractual interest because the defendant had merely been a guarantor.
