Lump sum by instalments

R v R (lump sum by instalments) [2004] 1 FLR 928

Although the husband’s family company offered to buy a house for the wife in which she could live, but would not own, the judge decided that it would be wrong for the wife to have to be beholden to her husband’s family while the husband was left with substantial assets. Although he could not pay a substantial lump sum immediately, the judge ordered him to pay it by instalments which would enable the wife to raise a mortgage on her own property The husband was ordered to pay £30,000 immediately and £225,000 over 20 years, being secured on the husband’s share in the family business.
