Judge was wrong to find claimant incredible

Coles v Greaves and another CA SJ 27 May

In a road traffic accident the claimant sustained a whiplash-type soft tissue injury to his neck and shoulders. Liability had been admitted and accordingly the trial judge had to determine quantum. The judge discounted a number of the claimant’s future losses on the basis that he had found the claimant’s account as to his ongoing symptoms incredible.
