Costs order set aside

Seiwa v Sankofa CA SJ 6 June

At the hearing of an application for committal of the father for breach of a non-molestation injunction, he was found to be in breach and was ordered to pay the mother’s costs of the application. The injunction was renewed and the committal proceedings adjourned. At the renewed hearing of the committal application, two allegations that the father had breached the injunction were made out, but since the determination of the committal application had been 10 months after the application and the incidents that had given rise to it, the judge made no order on the application. The father appealed on the grounds that the judge had failed to give adequate reasons for the order that he pay the mother’s costs.
