The claimant’s trustee in bankruptcy obtained a charging order absolute on his dwelling house on 29 May 1992 and the court removed the bankrupt’s interest in his property from his estate under s313 of the Insolvency Act 1986. In June 2004 the trustee applied for an order for the sale of the property with vacant possession.
