Privilege in mediation

Hall and another v Pertemps Group Ltd and another ChD TLR 23 December

The claimants’ action for the return of documents, injunctions in a confidentiality claim and a remuneration claim was stayed for mediation and settlement. After no settlement was achieved, the defendants paid £20,000 into court. Subsequently, after the defendants had withdrawn a second Part 36 offer, the claimants asked for permission to accept the first payment in, which was granted. The defendants then accepted that the claimants had a good proprietary claim for the return of the documents and the claimants applied for judgment on those admissions and for permission to discontinue the confidentiality claim.
