Order against non-party – 1

Petroleo Brasileiro SA and another v Petromec Inc and others [2005] EWHC 2430 (Comm)

A non-director of the claimant company controlled the litigation, provided all the funds needed to support the litigation and was personally interested in its outcome. He was the only person who stood to benefit from the outcome of the action. Accordingly it was appropriate to add him as a party to the litigation and make a non-party costs order against him.
