The claimant obtained judgment in default, which was not enforceable in India, where the defendant had its assets, because India does not recognise default judgments. The defendant opposed the claimant’s application to set the judgment aside to enable the claimant to obtain summary judgment on the grounds that the claim had merged in the judgment.
