7.1.1 Arbitration clause incorporated by reference averred to be invalid

THE FACTS

An arbitration clause was purportedly incorporated into a sub-contract by reference because that sub-contract was expressed to be subject to the main contract terms which incorporate JCT 80 (which itself includes an arbitration clause).
