EXPERT DETERMINATION
15.1.1 Independent expert or arbitrator?
THE FACTS
The President of the RICS received an application from one party to an agreement to appoint an independent expert. The RICS Disputes Resolution Service, on his behalf, requested details of the agreement between the parties authorising him to make such an appointment. In response the applicant stated that although unable to produce a copy of the agreement he was able to confirm that there was such an agreement. On the basis of this assurance the President appointed a chartered surveyor to be the independent expert.
