Litigation Letter

Copies of authorities

Sage (UK) Ltd v Bacco EAT TLR 11 October

It is the responsibility of parties and their representatives to ensure that where cases were reported those reports are included in the list of authorities and copied in the bundle. It helps the Appeal Tribunal, when pre-reading a case, to refer to the head note of an authority. It is not a sensible use of time to read through the entire judgment in order to assimilate the basic facts and holdings in the case. Also, it is useful to the readers of the Appeal Tribunal’s judgments to see precise references to passages in the earlier cases cited; that was often helped by references to the relevant lower court.
