Principle of equality

Vaughan v Vaughan [2007] EWCA Civ 1085; SJ 9 November

The departure from equality in the sharing of assets in ancillary relief proceedings may be justified in order to achieve greater equality in the overall outcome. Accordingly, an order did not infringe the sharing principle by imposing a division which represented a departure from equality to 57% in favour of the wife in circumstances where there was good reason for that inequality, such as the desirability of a clean break.
