Effect of remarriage

Marchant v Dixon CA TLR 4 March

Soon after the making of a consent order as to financial arrangements in a divorce settlement which, inter alia, provided for payment of a lump sum to capitalise her periodical payments, the wife remarried. The husband had at the time sought assurances from the wife that she had no intention of remarrying or cohabiting, and the judge found that her statement to this effect was true at the time she made it.
