Practice direction: Uncontested proceedings

Uncontested applications in the Administrative Court will now be dealt with under a procedure announced by Mr Justice Collins in the Queen’s Bench Division on 3 June, which replaces that set out in Practice Direction (Crown Office list: Consent orders) [1997] 1 WLR 825. The direction deals with the procedure on the termination of proceedings by consent, agreed interim orders, and discontinuance and withdrawal of proceedings (including proceedings for habeas corpus ) where the parties are agreed, but require the leave of the court, where the leave of the court is not necessary; where the claimant has filed a notice of discontinuance and where an appellant does not wish to pursue an appeal.
