Duty to child on bouncy castle

Harris v Perry and another [2008] EWCA Civ 907 31 July

The Perrys had hired a bouncy castle for their triplets’ 10th birthday party. The castle was of a size suitable for adults as well as children. It was pitched on a school playing field outside their back garden. While playing on the castle Sam Harris, aged 11, was struck on the head by the heel of a much taller and older boy performing a somersault. Sam suffered a depressed skull fracture and subdural haematoma. The accident occurred when Mrs Perry’s back was turned. She had gone to help another child.
