Mr Spencer made a claim against his employer for injury at work and a claim against the Secretary of State for Work and Pensions for failure to implement art 6(2) of Council Directive 89/391/EEC (OJ 1989 L183/1) into the Management of Health and Safety at Work Regulations (SI 1992 No 2051).
