Litigation Letter
Litigation privilege
West London Pipeline and Storage Ltd v Total UK Ltd [2008] EWHC 1729 (Comm); [2008] All ER (D) 294 (Jul)
Legal professional privilege protects two classes of documents. First, legal advice privilege which ensures the confidentiality
of communications between the client and solicitor whether or not litigation is contemplated or pending, and, second, litigation
privilege, which protects communications between a solicitor and a third party, directly or indirectly, after litigation is
contemplated or commenced in furtherance of that litigation.
