Page 141 9 Commercial Mediation Techniques The parties have reached an impasse, no amount of further discussion can move either side and the mediator has done everything that is possible all to no avail. This situation commonly arises in mediations and the cause usually is the mediator’s inability to use negotiation techniques effectively. In the area of international commercial mediation, mediators have to call upon varied skills and techniques to ensure that cultural differences are also not overlooked and that the best method for resolution of the dispute is employed—be that facilitative, evaluative, or deal brokering.
