Newall and anor v Lewis and ors [2008] EWHC 910 Ch D

A consent order was made at the conclusion of proceedings under CPR Part 8 by which the claimants Lucinda and Alexander Newall, being beneficiaries under certain family settlements, sought the removal of the defendants as trustees of the settlements. After recording the parties’ agreement that the defendant trustees should retire upon being given certain specified indemnities, the consent order provided:
