Warner v Verfides (a firm) Ch D TLR 6 November
In an application by a trustee in bankruptcy for disclosure of documents by the respondent under the Cross-Border Insolvency
Regulations 2006, the writers of certain correspondence intervened alleging the application by the trustee engaged their rights
under art 8 of the European Convention on Human Rights in respect of their private life, which extended to their business
activities. In the event, only a few documents were affected and these were excluded by the judge on the ground of irrelevance
rather than confidentiality. The only issue affecting the interveners was how their costs were to be borne, which raised the
question of whether they had had at least sufficient interest to intervene at all.
