What is stopping Personal Injury Mediation?

A seminar raising important issues concerning insurance related personal injury claims and the use of mediation to settle
such claims. Organised by The Forum of Insurance Lawyers. Chaired by Sir Anthony Clarke, Master of the Rolls The proposed
topics are: What is the evidence of lack of progress? Are the lawyers to blame? On what side? Is the Judiciary to blame, at
what level? Is the MoJ to blame? Is the Rules Committee to blame? What is the experience of insurer’s pilots? Is the volume
of cases sufficient, if not what are the reasons? What of pilots on the claimant side? Why are any of those parties resistant?
Concern about fees, loss of control, fear of the unknown, ignorance, size of claims, too expensive? Having identified the
factors preventing the development of mediation how do we tackle them?
