Easement created by lease – extinguishment by statute

Jones (Elizabeth) v Cleanthi (Christos Emmanuel) [2006] EWCA Civ 1712 (12 December 2006)

Most leases grant rights or easements to the tenant and often these can be very valuable and essential rights. The prospect that such rights might be lost will be of concern to most tenants. The Court of Appeal has upheld a decision of the High Court (Bell J) that such rights can be extinguished by statute.
