Hostel within dwelling house use class

R (on the application of Hossack) v Kettering Borough Council Queen’s Bench Division, 31 July 2003

Following the Court of Appeal’s decision in R (on the application of Hossack) v Kettering Borough Council ([2002] JPL 1206 – see (2000) 16 Commercial Leases 667), the matter returned to the borough council for reconsideration in the light of the principles laid down by the Court as to whether the use of several houses as a hostel for young people in need was in breach of planning law. The issue before Mr Justice Richards in the Queen’s Bench Division on 31 July 2003 was whether its decision (that it was not) was lawful.
