Planning and gypsies

In (2004) 18 Commercial Leases 900 we highlighted South Cambridgeshire District Council v Persons Unknown [2004] EWCA Civ 1280, in which the Court of Appeal upheld an appeal by the council and granted an injunction to restrain the depositing of hardcore and occupational use of land by the parking of caravans, which was a use contrary to planning control. The Court held that the statutory power to grant the injunction was set out in s187B of the Town and Country Planning Act 1990. Two more cases have now come before the Court of Appeal and we draw readers’ attention to them.
