Liablity for defective ramp

Smith v Northamptonshire County Council; [2009] UKHL 27; [2009] WLR (D) 165; TLR 21 May

The claimant was a care worker who regularly collected a client who was a wheelchair user, to take her for day care. Wheelchair access to the client’s house was by way of a wooden ramp, installed by the National Health Service, which led from the living room French windows to a patio. The claimant was injured when the edge of the ramp gave way as she pushed the wheelchair over it, causing her to stumble.
