Conflict of laws - Jurisdiction - Whether parties had entered into exclusive jurisdiction agreement - Council Regulation (EC) No 44/2001, article 23

The court here ruled that it had been shown the claimant had a much better argument than the defendant that an exclusive jurisdiction clause nominating England had been entered into in accordance with article 23 of Council Regulation (EC) No 44/2001 on the basis that it was in a form which accorded with practices which the parties has established between themselves (article 23(1)(b))
