A. COLLISIONS AND NON-CONTACT DAMAGE
10.1
As a matter of ordinary language, a collision occurs when two vessels come into contact with each other. The legal definition of collision extends beyond this to embrace damage caused by one vessel to another without contact, e.g. by her wash. The editors of Marsden contend that the”real question is not whether two ships come into contact, but whether the actionable fault of one person causes damage to another person or their property.”1
