Carey v HSBC Bank Plc and Associated cases [2009] EWHC 3417 (QB); NLJ 22 January p101

This judgment considered six preliminary issues of law in eight selected cases concerning requests for copies of credit card agreements pursuant to s78 of the Consumer Credit Act 1974. The purpose of the judgment was to give general guidance in the context of the cases before the court in the hope of narrowing or eliminating the issues arising in hundreds of other similar cases issued in county courts around the country, many of which had been stayed pending the outcome of these proceedings.
