Collaborative prenups

The Law Society Gazette of 21 January reported a rise in the number of clients seeking prenuptial agreements to be prepared using the collaborative law model involving a series of face-to-face meetings between the parties and their lawyers. Gillian Bishop was quoted as saying the collaborative approach diminishes any inequality in power between the parties. Agreements are more likely to be upheld in court because it would be harder for one party to say they have no choice about entering the agreement where they have attended several joint sessions and actively participated in the discussions.
