Fundamental breach by employer

Buckland v Bournemouth University Higher Education Cooperation [2010] EWCA Civ 121; SJ 2 March p154

After Professor Paul Buckland, an environmental archaeologist at Bournemouth University, had marked a set of papers, university staff arranged for further marking to be carried out, resulting in some students being able to pass if their results in other subjects were good enough. He alleged this was a fundamental breach of the terms of his employment which amounted to constructive dismissal.
