The end of Hildebrand

Tchenguiz and others v Imerman; Imerman v Imerman [2010] EWCA Civ 908; SJ 3 August p32; NLJ 13 August p1134

In divorce proceedings the wife’s brother accessed the husband’s documents stored on a server. Seven files of those documents were passed on to the wife’s solicitors. In summary proceedings, the wife’s brother was restrained from communicating, disclosing or copying to third parties any information in those documents. He appealed. The husband sought the return of the seven files and any copies and an order preventing the wife from using any information obtained from them. The judge ordered the seven files to be handed back to the husband, to enable him to remove any material for which he claimed privilege, but that the husband should then return the remainder of the documents to the wife for use by her in connection with the matrimonial proceedings. The husband appealed that decision.
