Costs and unreasonable actions

When exercising its discretion under rule 40 of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2004 to order costs against a party who had acted unreasonably in bringing or conducting proceedings, it was vital that the employment tribunal looked at the whole picture of what happened in the case.
