Barrett v Bem and Ors [2012] EWCA Civ 52; 21 March 2012

The signature at the direction of the testator is an alternative to signature by the testator personally. However the court should not find that a will had been signed by a third party at the direction of the testator unless there had been positive and discernible communication, verbal or non-verbal, by the testator that he wished the will to be signed on his behalf by the third party.
