The test for arrest

The Singapore Court of Appeal on 21 August 2012 handed down a judgment of practical significance for ship arrest in that important jurisdiction. The respondent and a company that was not a party to the proceedings (MAL) had concluded a Bunker Fixed Price Agreement (BFPA) for the supply of bunkers to the respondent’s ships.
