Charterparty – Off-hire – Vessel detained by court order at discharge port – Order procured by C&F seller to secure demurrage claim against cargo receivers – Whether sellers and/or receivers “agents” of charterers – Whether vessel off-hire

The claimant owners (NYK) chartered the vessel Global Santosh to the defendant charterers (Cargill) on an amended NYPE form for one time charter trip from Sweden to West Africa. Cargill sub-voyage-chartered the vessel.
