Insurance (motor) - Bus damaged in motor accident - Measure of damages for public service vehicle
This case raised the question of the proper measure of
damages where a public service vehicle is damaged. The Court of Appeal held
that the proper basis on which to assess general damages for the loss of use of
a public service vehicle is normally interest on capital value (if it is owned)
or the daily hire rate (if it is leased) together with depreciation and
expenses thrown away.
