Costs against unreasonable claimant

Sud v Ealing London Borough Council CA TLR [2013] EWCA Civ 949; 23 October

Although an award of costs against a paying party in the employment tribunal was an exceptional event, if the tribunal concluded that the claimant’s conduct of the proceedings had been unreasonable, the tribunal should identify the particular unreasonable conduct by a broad brush approach and award costs accordingly.
