Solicitors’ retainer
Bentine v Bentine CH/2012/0628 17/10/2013; PI Costing Ltd [2013] EWHC 3098 (Ch); 13 November
A case was brought by a mother against her daughter in the Central London County Court for the court to determine their respective
beneficial interests in certain property. During the dispute, it became clear that the daughter was losing capacity, and after
medical confirmation the Official Solicitor agreed to act. During the period of uncertainty, the solicitors continued to act.
When the case was settled and costs fell to be assessed, there was also issue between the daughter and her solicitors on the
various invoices submitted by them.
