The claimants were injured in a motor accident in
Lithuania, the fault of the driving of a Lithuanian national. At the date of
the accident the driver had no insurance. The question was whether the amount
payable by the Motor Insurers' Bureau was to be assessed under English law or
Lithuanian law (the latter imposing a cap).
