Assessing damages for wrong valuation

Titan Europe 2006-3 plc v Colliers International UK plc (in liquidation) [2015] EWCA Civ 1083, [2015] All ER (D) 37 (Nov) NLJ 13 November

The Court of Appeal allowed the defendant’s appeal against the judge’s finding that it had been negligent in making its valuation of €135m of a commercial property. However, it held, obiter, that, if the defendant had been negligent, the claimant could have recovered the difference between the valuation and the “correct” value, whatever that was.
