Enforcing Nigerian award

IPCO (Nigeria) Ltd v Nigerian National Petroleum Corporation [2015] EWCA Civ 1144, [2015] All ER (D) 103 (Nov); NLJ 27 November

The Court of Appeal ordered, among other things, that the claimant’s application to enforce an arbitration award made in Nigeria should be adjourned pending the determination by the Commercial Court, pursuant to s103(3) of the Arbitration Act 1996, as to whether the award should not be enforced in whole or in part because it would be against English public policy so to do. That order would be conditional upon the provision by the defendant of further security.
