Pensions – Automatic enrolment into pension scheme – Whether seafarers fell within territorial scope of Pensions Act 2008

The claimant, Fleet Maritime Services (Bermuda) Ltd (the Employer), was a company incorporated in Bermuda. The Employer was a wholly owned subsidiary of Carnival plc, an English company. Carnival owned the ships which traded under the names of P&O Cruises and Cunard. Most of the ships were registered in Bermuda.
