A. The Maritime Code (MC)

1. Salvage

New salvage rules in accordance with the 1989 Salvage Convention came into force on 1 January 1997. The new provisions are available in English from the Maritime Law Institute at the University of Stockholm.

2. Others

Act (1996:268) amending the Maritime Code (1994:1009). Minor amendments of 12:3 and 18:10 involving the application of the Act (1996:242) of Court Matters in matters concerning the limitation fund and Maritime Declaration unless the MC declares otherwise.

B. Vessels

1. Registry

Proposed amendments of rules of registry

By memorandum Ds 1996:60 the Ministry of Justice proposes new rules for registry of vessels permitting the entry of foreign vessels operated by EC citizens or persons in the Swedish ship register. The amendments are motivated by a number of decisions of the EC Court, particularly the so-called Factortame 2 decision CC–221/89 concerning Great Britain’s measures against Spanish fishing interests’ establishment in Britain to obtain part of the British fishing quotas.
