I write with regard to the analysis of this case by Mr P. Wiwatpattarakul in [1989] 2 LMCLQ 143. My firm were the solicitors in the case acting on behalf of Coastal. I would like to correct some inaccuracies of fact which appear in the Comment.
In his final paragraph, the author states that the decision in the case should have been made on the short ground that Coastal’s case failed because on the facts Coastal was in breach of condition by reason of the failure of the Aragon to berth and allow sufficient time to take delivery of the cargo before the expiry of the threeday period.
