Non-molestation and occupation orders not discharged

PF v CF [2016] EWHC 3117 (Fam), 2 December 2016

The Family Court considered a husband’s appeal against a non-molestation order against him and an occupation order in respect of the matrimonial home. The key statutory provisions for the orders were ss33 and 42 of the Family Law Act 1996, and the court had to consider whether the lower court was wrong or unjust because of a serious procedural or other irregularity.
